Agreement to Terms

By accessing or using the Charlie & Mabel website (the “Site”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site. The Site is operated by MD&A INC., doing business as Make More Creative (“we”, “us”, “our”).

Intellectual Property

All content on this Site -- including but not limited to comics, illustrations, characters, character designs, text, graphics, logos, and website design -- is the property of MD&A INC. and/or Michael Dargie and is protected by Canadian and international copyright law.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from this Site without express written permission, except for personal, non-commercial use (such as sharing a link to a comic on social media).

User Accounts

You may create an account to access certain features such as commenting and order history. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 13 years of age to create an account.

Comments and User Content

When you post comments on the Site, you grant us a non-exclusive, royalty-free licence to display your comments on the Site. You retain ownership of your comments.

You agree not to post content that is:

• Abusive, harassing, threatening, or hateful
• Spam or unsolicited advertising
• Illegal or in violation of any third party's rights
• Sexually explicit or obscene
• Impersonating another person

We reserve the right to remove any comment and to suspend or terminate accounts that violate these guidelines, at our sole discretion.

Shop and Purchases

Products are sold as-is. Prices are listed in Canadian Dollars (CAD). We reserve the right to change prices at any time. All purchases are final unless the product arrives damaged or incorrect, in which case please contact us within 14 days of receipt.

Payment processing is handled by Stripe. By making a purchase, you also agree to Stripe's terms of service.

Shipping

We ship to Canada and the United States. Shipping times and costs are displayed at checkout. We are not responsible for delays caused by shipping carriers or customs.

Limitation of Liability

The Site and its content are provided “as is” without warranties of any kind. To the fullest extent permitted by law, MD&A INC. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site.

Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Calgary, Alberta.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
